Conditions of Use and Occupancy

All of our leases have the following document as an attachment:

The following policies are a tenant’s guide to house rules and operation and maintenance requirements on the rental accommodation you occupy.

1.     RENT DUE – Rents are due on the first day of each month, payable by e-transfer 

2.     RENT PAST DUE – Rent past due more than 5 days may result in issuance of “notice to vacate”..

3.     STEREO/TV – Stereos, televisions, computers, video games are to be kept turned down so as not to disturb others.  If they can be heard outside your apartment, the sound is too loud.  Loud parties or large groups of people at your apartment will not be tolerated. The Town of Sackville Noise By-Law 182 will apply.

4.     COUNTER TOPS – Please use cutting boards & heat protectors on countertops to avoid damage.

5.     LOCKS – Additional locks may not be installed without consent of the owner/manager.  We must have a key for any additional locks installed if allowed

6.     LOCKED OUT – A lock out fee of $10.00 will be charged to provide keys, if applicable, to enter your house or apartment because yours are lost, misplaced, locked inside or not otherwise available to you when you need them.  Our office hours are 8:30am to 5pm and we may be contacted at 870-0392. The fee will be charged evenings, weekends, and holidays and is payable on the spot. You may arrange to pick up the necessary keys & return them to me the same day without charge.

7.     RESPONSIBLE ACTIONS – All leasees are jointly responsible for the actions of anyone on the premises, whether the leasee is present or not.  Everyone residing in the apartment will be named in the rental agreement.

8.     INSURANCE – The owner does not carry insurance to cover liability for your actions or coverage for your personal property if damaged.  Theft, disturbance by others, and damage to property caused by your actions is your responsibility.  Management is not responsible for personal items stolen from a tenant or guest of the tenant, whether stolen from the apartment building/house or personal automobiles. We strongly advise all tenants to get Tenant Insurance. Students should check whether their parents have coverage under their Homeowners Insurance while they are at school. If you are not covered by parents, please get Tenant Insurance – a recent fire highlighted how important this is

9.     WINDOWS – Do not remove window screens or use windows as an entrance to your apartment.  Replacement of broken windows & damaged screens is the responsibility of the tenant, even if the cause is accidental.

10.  WALLS – Walls are washable with care.  Use a clean cloth and a mild detergent.

11.  PLUMBING – If the drainage plumbing exclusively serving your apartment becomes blocked due to an object originating from your apartment, it shall be the responsibility of the tenant to pay for charges to clear the blockage.

12.  APPLIANCES – Appliances provided with the apartment are to be kept clean, with no parts removed.  At vacancy, they must be thoroughly cleaned.  Stoves and range hoods must be cleaned of baked-on grease and food.  Refrigerators must be frost-free and empty.

13.  PARKING- Tenants vehicles are to be parked on driveways provided. Do not park on the lawns. Winter parking at street side is not permitted from Nov 30 to Mar 31 under penalty of tow-away as per the Town of Sackville Parking By-Law.

14.  SNOW REMOVAL – With multiple units, the owner will arrange snow clearing of common parking areas and common walkways.  If you have a private walk, doorstep, or entry, you are responsible for shoveling after each snowfall.  Walking surfaces should be kept bare for safety and to prevent doors from icing so they do not close.  Occasional use of ice salt may be necessary.

15.  GARBAGE – Garbage must be bagged and removed from your apartment weekly.  Recyclable and refundable items should be removed at least monthly.  Municipal garbage pickup is done weekly at curbside. Any additional charges for garbage/refuse removal levied by the garbage contractor or the Town of Sackville will be the responsibility of the tenant(s). The Green (compostable), Clear (garbage) and Blue (recyclables) sorting method shall be followed by the tenants to conform to the Town of Sackville Garbage By-law.

16.  PETS – No pets are permitted without notice to and consent from the owner/manager.  If permission is granted, a special “pet clause” must be added to your lease.  The special obligations of the pet clause shall be determined at the time of request, depending on the type of pet and your accommodations.

17.  SMOKING- This is a NON-SMOKING accommodation. Any smoking must occur outdoors. Failure to accept this condition will result in a security deposit claim for cleaning, restoring & redecorating to eliminate accumulated residue from smoking. The same obligations may be applied for cumulative damages from open flame or burning activities such as candles or incense.

18.  DEEP FRYING – NO DEEP FRYING allowed unless a purpose-built enclosed deep-fryer is used

19.  CANDLES/INCENSE: No candles or incense to be burned inside – there are 3 other apartment tenants who may be at risk in the event of a fire from these items being left unattended.

20.  PICTURE HANGING- We require that use of picture hangers be limited to one fixture per wall. The use of adhesive fasteners, staples or nails may result in additional expense for restoring walls and trim.

21.  OBLIGATIONS AT VACANCY – Following notice to vacate from the tenant, there are minimum standards of cleaning, repair, and wear and tear, which the tenant must meet.  A schedule of “Obligations at Vacancy” will be provided when notice to vacate is received.

22.  SECURITY DEPOSIT CLAIM – The owner/manager may claim such expenses as unpaid rent, loss of rent due to inadequate notice, cleaning, garbage removal, damages, & other costs that are the obligation of the tenant.

23.  TENANCIES ACT – All of the terms and conditions of the standard form of lease #6 are governed by the Residential Tenancies Act of New Brunswick, 1975, and its amendments.  The management reserves the right to make such other rules and regulations from time to time as may be deemed necessary for the safety and convenience of all tenants.  It is the responsibility of the tenant to thoroughly read the rental agreement and attached regulations.

24.  NOTICE OF CHANGE – Any of these items may be changed with appropriate written notice.
